It’s Time For Party

Rental Agreement, Liability Waiver & Assumption of Risk
This Agreement is entered into between MAKA Party & Co., LLC (“Company”) and the undersigned Client (“Client”) for the rental and/or use of party equipment and services.

1. RENTAL TERMS & CONDITIONS
Client agrees to rent equipment from MAKA Party & Co., LLC for the agreed-upon date, time, and location. Equipment may include but is not limited to: soft play equipment, inflatables, ball pits, bounce houses, décor, and party rentals.
Client agrees:
- Equipment will be used only for its intended purpose
- Equipment will remain at the delivery location
- Equipment will not be moved, altered, or modified
- Equipment will be supervised at all times

2. ASSUMPTION OF RISK
Client acknowledges that participation in activities involving party rental equipment involves inherent risks, including but not limited to:
- Slipping, tripping, falling
- Collisions
- Minor or serious injury
- Property damage
Client voluntarily assumes all risks, known and unknown, associated with use of the rented equipment.

3. RELEASE & WAIVER OF LIABILITY
Client hereby releases, waives, discharges, and covenants not to sue MAKA Party & Co., LLC, its owners, employees, contractors, or representatives from any and all claims, demands, actions, or causes of action arising out of:
- Personal injury
- Death
- Property damage
related to use or misuse of the rented equipment, even if caused by negligence, except where prohibited by law.

4. SUPERVISION REQUIREMENTS (SIOTO-STYLE)
Client agrees:
- Adult supervision is required at all times
- Children must remove shoes, sharp objects, glasses, jewelry, and food
- No climbing on walls, standing on equipment edges, or rough play
- No flips, wrestling, or horseplay
- Children must be of appropriate age, height, and weight for the equipment
- No more than the manufacturer’s recommended capacity may use the equipment at
one time

Failure to follow safety rules may result in immediate termination of use without refund.

5. WEATHER & SAFETY CONDITIONS
Client understands:
- Equipment may not be used during high winds, rain, lightning, or unsafe conditions
- MAKA Party & Co., LLC reserves the right to remove equipment if conditions are deemed unsafe
- Client is responsible for ensuring a clear, level, and safe setup area

6. DAMAGE, LOSS & CLEANING
Client assumes responsibility for:
- Damage beyond normal wear and tear
- Theft, vandalism, or misuse
- Excessive cleaning due to food, drinks, slime, paint, or bodily fluids

Client authorizes MAKA Party & Co., LLC to charge repair or replacement costs if necessary.

7. INDEMNIFICATION
Client agrees to indemnify and hold harmless MAKA Party & Co., LLC from any claims, damages, losses, or legal expenses arising from:
- Client’s negligence
- Guest misuse
- Failure to follow safety instructions

8. MEDICAL AUTHORIZATION
Client authorizes MAKA Party & Co., LLC to seek emergency medical treatment for participants if necessary and agrees to be responsible for any medical expenses incurred.

9. PHOTO & VIDEO RELEASE (Optional but Recommended)
Client grants permission for MAKA Party & Co., LLC to use photos or videos taken during the event for marketing and promotional purposes unless otherwise stated in writing.

10. PAYMENT, CANCELLATION & REFUNDS
- Full payment required prior to event date
- Deposits are non-refundable
- Weather-related cancellations may qualify for rescheduling at Company discretion

11. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Texas.

12. ENTIRE AGREEMENT
This document constitutes the entire agreement between the parties. No verbal agreements shall modify these terms.
